1. Acceptance of Terms
By creating an account on Sendflo or using any part of our service, you agree to these Terms and Conditions. If you are using Sendflo on behalf of a company or organization, you confirm that you have the authority to bind that entity to these terms. If you do not agree, please do not use the service.
2. What Sendflo Does
Sendflo is a business-to-business messaging platform. It lets you send bulk campaigns over WhatsApp, email, and SMS. The platform includes contact management, delivery tracking, AI-assisted content tools, and a credit-based billing system. You buy credits, and each message you send uses credits. The specific features available to you depend on your plan.
3. Account Registration and Eligibility
Sendflo is designed for businesses. By signing up, you represent that you are at least 18 years old and are acting on behalf of a legitimate business entity. You agree to provide accurate, current information during registration and to keep it updated. You are responsible for everything that happens under your account, including maintaining the confidentiality of your login credentials. If you suspect unauthorized access, contact us immediately at support@sendflo.io.
4. Acceptable Use
You are fully responsible for the messages you send through Sendflo. This is a tool for legitimate business communication, not a vehicle for spam. Specifically, you agree that you will not:
- Send messages to anyone who has not given you clear, verifiable consent to receive them.
- Send spam, phishing attempts, or deceptive content of any kind.
- Use the platform to harass, threaten, or abuse anyone.
- Send content that is illegal in any jurisdiction where your recipients are located.
- Transmit malware, viruses, or any harmful code through our platform.
- Attempt to circumvent sending limits, rate limits, or any other technical restrictions.
- Use Sendflo to send messages related to illegal products or services.
- Resell or redistribute access to Sendflo without our written permission.
We take misuse seriously. If we determine that you are violating these rules, we may suspend or terminate your account without notice and without refund.
5. Credits and Billing
Sendflo operates on a credit-based billing model. You purchase credits, and those credits are consumed when you send messages. Credit costs vary by channel (WhatsApp, email, SMS) and may change with notice.
Refund policy: If you are unsatisfied with your purchase, you may request a refund of unused credits within 7 days of the original purchase by contacting support@sendflo.io. Refunds are issued at our discretion and will not be granted if credits have been partially or fully consumed. After 7 days, credits are non-refundable. If your account is terminated for a violation of these terms, any remaining credits are forfeited.
If you are on a subscription plan, it will renew automatically at the end of each billing cycle unless you cancel before the renewal date. You can cancel your subscription at any time from your account settings, and it will remain active through the end of the current billing period.
You agree not to initiate chargebacks or payment disputes without first contacting us at support@sendflo.io to resolve the issue. Unauthorized chargebacks may result in account suspension.
6. WhatsApp, Carrier, and Third-Party Compliance
Users must obtain explicit opt-in consent from recipients before sending WhatsApp messages through Sendflo. WhatsApp messages must comply with Meta's WhatsApp Business Policy and WhatsApp Commerce Policy. SMS messages must comply with applicable carrier rules and telecommunications regulations, including the TCPA in the United States or equivalent laws in your jurisdiction. Email must comply with anti-spam laws such as CAN-SPAM, GDPR, and CASL where relevant.
If a third-party provider (Meta, a carrier, or an email provider) blocks, delays, or rejects your messages, that is not our responsibility. These platforms have their own enforcement policies, and it is your job to comply with them.
7. Intellectual Property
Sendflo owns its platform, including the software, design, branding, and documentation, and these are protected by intellectual property laws. Using the service does not give you any ownership rights in it.
The content you create and send through Sendflo (your messages, templates, and contact lists) remains yours. By uploading content to our platform, you give us a limited license to process and transmit it solely to deliver the service to you.
8. Data and Privacy
Our Privacy Policy covers what data we collect, how we use it, and who we share it with. By using Sendflo, you agree to those practices.
You are responsible for ensuring that your use of Sendflo, including the contact data you upload and the messages you send, complies with all applicable data protection laws (including GDPR, CCPA, and others relevant to your business and recipients).
9. Service Availability
We work hard to keep Sendflo reliable and available, but we do not guarantee 100% uptime. The service is provided on a best-effort basis. We may occasionally need to perform maintenance, deploy updates, or deal with outages caused by third-party providers. We will make reasonable efforts to notify you of planned downtime in advance.
Sendflo is not liable for losses from service interruptions, delivery delays, or downtime, whether scheduled or not.
10. Limitation of Liability
To the maximum extent permitted by law, Sendflo's total liability to you for any claims arising from your use of the service is limited to the amount you paid to Sendflo in the three (3) months immediately preceding the event that gave rise to the claim.
Sendflo is not liable for indirect, incidental, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we were aware that such damages were possible.
11. Indemnification
You agree to indemnify, defend, and hold harmless Sendflo, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your use of the service, your violation of these terms, the content of messages you send, or your violation of any third-party rights or applicable laws.
12. Termination
You can close your account at any time by contacting support@sendflo.io. We may suspend or terminate your account at our discretion if we believe you have violated these terms, if your account is being used for illegal activity, or if continuing to provide service to you poses a risk to our platform or other users.
Upon termination, your right to use Sendflo ends immediately. We may retain certain data as described in our Privacy Policy or as required by law.
13. Governing Law and Disputes
These terms are governed by the laws of the Republic of India, without regard to conflict-of-law principles. Any disputes arising under these terms that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts located in Noida, Uttar Pradesh, India. Before pursuing formal legal action, both parties agree to attempt to resolve disputes through good-faith negotiation for at least thirty (30) days.
14. Changes to These Terms
We may update these terms from time to time. When we make material changes, we will notify you by email or through the platform. Your continued use of Sendflo after changes take effect constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using the service and close your account.
